Terms of Use Agreement

Introduction: Our online store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all legal implications resulting from your use of the store’s services via the internet and this electronic platform. Any person’s use of the store, whether as a consumer of a service or product or otherwise, constitutes an agreement and acceptance, while in full legal capacity, to all the articles and provisions of this agreement and is a confirmation of your commitment to its regulations and what is mentioned therein. This agreement applies to all types of dealings between the consumer and [Store Name]. This agreement is considered effective and valid once you agree to it and begin registration in the store, pursuant to Article Ten of the Saudi Electronic Transactions Law.

Article 1 - Introduction and Definitions: The preamble above is an integral part of this agreement. Below are the meanings and definitions of the key terms used in this agreement:

  1. (The Store): Includes all forms of the store on the internet, whether it is an electronic application, a website, or a commercial shop.
  2. (The Consumer): The person who engages in e-commerce with the desire to obtain the products or services provided by the store via its electronic platform.
  3. (The Agreement): Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article 2 - Legal Capacity of the Consumer:

  1. The consumer acknowledges that they have full legal capacity recognized under Sharia and law to deal with the store, or that they are at least eighteen years old.
  2. The consumer agrees that if they violate this article, they shall bear the consequences of this violation before third parties.

Article 3 - Nature of Commitment:

  1. The store’s commitment toward consumers is to provide (the service or product).
  2. The store may provide other services, such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the consumer.

Article 4 - Usage Controls:

  1. The consumer is committed to using the store’s electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
  2. The consumer is committed, when purchasing a service or product, not to use such service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article 5 - Accounts and Registration Obligations: Upon applying for membership in this store as a user, you are committed to disclosing specific information and choosing a username and a secret password to be used when accessing the store's services. Thereby, you agree to:

  1. Be responsible for maintaining the confidentiality of your account information and password. You agree to notify the store immediately of any unauthorized use of your account information or any other breach of your confidential information.
  2. The store shall not, under any circumstances, be responsible for any loss that may be incurred by you, directly or indirectly, morally or materially, as a result of the disclosure of the consumer name or login password.
  3. You are committed to using your account or membership yourself, as you are fully responsible for it. If someone else uses it, this is evidence that you have authorized them to use the store in your name and on your behalf.
  4. You are committed to using the store with seriousness and credibility.
  5. You are committed to disclosing true, correct, updated, complete, and legal information about yourself as required during registration and are committed to updating your data if it changes or if necessary.
  6. Our store is committed to treating your personal information and contact addresses with strict confidentiality.
  7. If the store discovers that you have disclosed untruthful, incorrect, outdated, incomplete, or illegal information, or information contrary to what is stated in the Terms of Use, the store has the right to stop, freeze, or cancel your membership or your store and account on the platform, without prejudice to the store's other rights and legitimate means of recovering its rights and protecting other consumers.
  8. In case of non-compliance with any of the above, the store management has the right to stop or cancel your store or membership or block you from accessing the store’s services again.

Article 6 - Electronic Communications and Official Means of Communication:

  1. The parties to this agreement agree that communication shall be conducted via the email registered on the platform.
  2. The consumer agrees that all agreements, advertisements, data, and other communications provided electronically replace their written counterparts and are sufficient evidence in fulfilling legal and Sharia requirements.
  3. The consumer agrees to the possibility of being contacted and notified of any provisions regarding this agreement or dealings with them through the store management broadcasting general messages to all consumers or to specific users.

Article 7 - Amendments to the Terms of Use and Fees:

  1. In the event that any article or clause in this agreement is canceled or becomes invalid, such matter does not cancel the validity of the remaining articles, clauses, rules, and provisions of this agreement, which shall remain in effect until further notice from the store management.
  2. This agreement—which is amended from time to time as needed—constitutes the mechanism of work, understanding, and agreement between (the consumer) and (the store).
  3. The store may impose fees on some consumers depending on the offers, products, or services they request, or taxes imposed by the state on the nature of the product or service.
  4. The store reserves the right to add, increase, decrease, or deduct any fees or expenses pursuant to the articles, clauses, and provisions of the Terms of Use, regardless of the reason for the consumers' registration.

Article 8 - Payment and Settlement Services for Stores in the Store:

  1. Through its partners, the store provides a payment and settlement system. Payment can be made entirely online through the payment options available on the store or through any payment method the store provides from time to time.
  2. The store is committed to determining the price of the service or product it displays in its store according to the recognized market value.
  3. The store is committed to providing invoices, receipts, and delivery notes for all amounts and profits arising in its store, and is committed to giving the consumer an invoice for their purchase of a service or product.
  4. The store is committed to providing recognized accounting specifications in its electronic store, in implementation of the provisions of this agreement and the legal, economic, commercial, and organizational interests involved in this regulation.

Article 9 - Intellectual Property:

  1. The intellectual property rights of the store are rights fully owned by the store, whether they were owned by them before the establishment of this electronic platform or after its establishment.
  2. The consumer respects the intellectual property rights of the store, including the store's name, words, logos, and other symbols of the store or displayed on it, as every right associated with the store's name is the full intellectual property of the store.

Article 10 - Store Responsibility:

  1. The store is committed to conducting its commercial business through this electronic platform legally and in accordance with the regulations in force in the Kingdom of Saudi Arabia and the provisions of this agreement.
  2. The store does not bear any claims arising from errors or negligence, whether resulting directly, indirectly, accidentally, or through the consumer or a third party such as shipping companies.
  3. [Store Name], its employees, owners, and representatives are committed to ensuring that the (product or service) is sound, legal, and authorized according to the laws and regulations of the Kingdom of Saudi Arabia and is used for legal purposes.

Article 11 - Restriction of Access or Membership: The store may stop or cancel the consumer’s membership or restrict the consumer’s access to the platform’s services at any time, without warning, for any reason, and without limitation.

Article 12 - Governing Law or Regulation: This Terms of Use agreement is governed and formulated according to the laws, regulations, and legislation in force and applicable in the Kingdom of Saudi Arabia, and is subject completely and entirely to the regulations in force with the authorities in the Kingdom of Saudi Arabia.

Article 13 - General Provisions: In the event that any article or clause in these Terms of Use is canceled or becomes invalid, such matter does not cancel the validity of the remaining articles, clauses, and provisions of the Terms of Use, which shall remain in effect until further notice from the store management. This Terms of Use agreement—which may be amended from time to time as needed—constitutes the Terms of Use, mechanism of work, understanding, agreement, and contract between the store and the consumer. Both parties to this agreement also agree to take into account the following:

  1. The Arabic language is the language used when interpreting the provisions of this agreement or when translating it into another language.
  2. All prices displayed for the store's services or products may be amended from time to time.
  3. Promotional or marketing offers that the store may place are temporary offers; the store has the right to amend these offers at any time or discontinue them.
  4. The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules and the applicable regulations and laws related to the nature of the dealing between the store and the consumer.
  5. This Terms of Use agreement shall not be canceled except by a decision issued by the store management.
